USCIS H1B Visa 2010 Application Status, Update and News at www.USCIS.gov
www.USCIS.gov is the government website, which provides H-1B visa. In the United States, the H-1B is a non-immigrant visa under the Immigration and Nationality Act, section 101(a) (15) (H). Some U.S. employers use H-1B visa program to employ foreign workers in specialty occupations that require theoretical or technical expertise in a specialized field and a bachelor’s degree or its equivalent. The worker can find another employer, or apply for a change of status to another non-immigrant status, or must leave the U.S., if a foreign worker in H-1B status quits or is dismissed from the sponsoring employer.
Architects, engineers, computer programmers, accountants, doctors and college professors are included in typical H-1B occupations. Certain fashion models of distinguished merit and ability and up to 100 persons who will be performing services of an exceptional nature in connection with Department of Defense (DOD) research and development projects or co-production projects are also included in the H-1B visa program. 65,000 is the current annual cap on the H-1B category. All H-1B non immigrants are not a subject to this annual cap. During each fiscal year, up to 6,800 visas may be set aside from the cap of 65,000 for the H-1B program under the terms of the legislation implementing the U.S.-Chile and U.S.-Singapore Free Trade Agreements. The use of H-1B for the next fiscal year, unused numbers in this pool are made available.
How to get an H-1B Visa:
If you want to get H-1B Visa then you have to follow the instructions.
1.) First of all you have to find a reliable company to sponsor your H-1B Visa. You have to be sure that company is not blacklisted by USCIS by checkink the reputation of the company on Google.
2.) You have to know the laws about filing of H-1B. For daily update, you have to register at www.USCIS.gov. You have to also register on some immigration bulletin about updates about H1b visa.
3.) You have to set up the timeline:
- You should have H1b sponsors name, with whom you want to file your H1B, till 15 January
- For H1b filing and prepare your folder at that moment, get checklist
- To have a feel about authenticity of the company, personally meet with your H1B sponsor
- You should submit your documents to your company till 15 February, so that company has enough time to pass it to the lawyer
- Your visa application with all documents should be ready till 15 March
- By 1st April, your application should reach USCIS office
- Only between specific dates, USCIS accepts the visa application
4.) About date window, you have to check the updates. In these dates, USCIS will assign a Receipt Number to your visa application. Your employer will get Notice of Action with EAC#, if your visa application gets selected in lottery. (EAC# doesn’t reflect that your H1b visa is approved.)
5.) Mostly you will receive an update on your status on EAC# till 1st October. On www.USCIS.gov website, you can check your EAC# updates.
H1B Visa 2010 Application Status:
If you want to check your case status then you have to go on my case status page and enter your receipt number, which is of 13 characters and you have received from the USCIS, it begins with three letters such as (EAC, WAC, LIN, or SRC). Dashes (“-”) should be omitted when entering a receipt number. After entering receipt number, click on check status option. You will find 7 steps of checking status, such as:
1.) Acceptance: USCIS reviews newly received application and petitions to ensure that they are properly filed, during the acceptance step.
2.) Initial Review: USCIS initiates the background checks of the applicant or petitioner and identifies issues during the initial review. These issues may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation.
3.) Request for Evidence: when an application or petition is lacking required documentation or evidence or the officer needs other documents to determine an applicant’s eligibility for the benefit sought, a Request for evidence is made.
4.) Testing and interview: you have either been scheduled for an interview or are n line to be scheduled for an interview, if your status indicates that you are currently in the testing and interview step.
5.) Decision: the former decision is written and the decision notice is mailed to the applicant or petitioner, in decision step. When you except to receive a final decision, you can use current processing time to gauge.
6.) Post Decision Activity: post Decision Activity may include USCIS sending notification of the approved application or petition to the national visa center or the department of state, for approved applications or petitions. Post Decision Activity may include the processing of an appeal and motions to reopen or reconsider and revocations, for denied applications or petitions.
7.) Document Production or Oath Ceremony: to provide a card (green card) or other document (a neutralization certificate, refugee travel document or advance parole) to an applicant, Document Production or Oath Ceremony step applies to application. From the time order to produce the card or document is given until the card or document is produced and mailed to the applicant, application will be the Document Production or Oath Ceremony step.

Please I need your help, my form is I130 and the status states document production. However, the problem is that the status says that the post office returned the document on feb. 5 as undeliverable giving a period at the end of which document will be destroyed. We called your number and your ever posting the document was denied. USCIS could you make some clarity here.
